To  assure  compliance,  in  app  setup  we  recommend  to  TICK  the

                 Gas Safe Certificates:    Annual gas safety checks must be conducted
                 by a Gas Safe registered engineer. Tenants must be given a record of
                 the  check,  either  within  28  days  of  it,  or  in  the  case  of  a  new

                 tenancy, before they move in .   This is  why in the ‘Welcome &
                 Utilities’ step ‘gas safe certificates’ are pre-ticked to auto send.

                 HMO Licences:
                 For the purposes of the Housing Act 2004 a building or a part of a
                 building is a “house in multiple occupation” if as defined by
                 Section 254 it:

                 (a)   meets the conditions in subsection (2) (“the standard test”);
                 (b)   meets the conditions in subsection (3) (“the self-contained flat test”);
                 (c)   meets the conditions in subsection (4) (“the converted building test”);
                 (d)  an HMO declaration is in force in respect of it under section 255; or
                 (e)  is a converted block of flats to which section 257 applies.

                 As  part  of  mobilisation  as  Operator  Ringley  would  deal  with  HMO  registrations  of  which  under  the
                 Housing Act 2004, Part 2 there are four types:
                   1)   HMO Licence bedsits  - S254(2)(a) Housing Act 2004,

                   2)   HMO Licence unit > 3 storeys, 5 persons, 2+ households – S55(2)(a) Housing Act 2004 which refers to
                   the Licensing of Houses in Multiple Occupation (Prescribed Descriptions) (England) 2006 S3(3).
                   3)   HMO ‘designated area’  -  (Part 2, S56) Housing Act 2004,
                   4)   Selective Licence 2+ households in flat  - (Part 3, S79-80) Housing Act 2004.

                 Typically, licences will be required because the building is more than three storeys, sharers in three bed
                 apartments is more than 2 single person households and/or the building may be situated in a designated
                 area.   Licences generally last for a maximum of five years.   There is a presumption in the Act that the
                 licence  holder  will  be  the  landlord  and  on  sale  the  new  landlord  will  have  to  apply  for  new  HMO
